WEBSITE TERMS OF USE AND DISTANCE CONTRACT

SIA "KRISTĀLA KURPĪTE", Reg. Nr.: LV52402006111, address: Atbrīvošanas aleja 130, Rēzekne, LV-4601, hereinafter referred to as ‘online store’ provides the content available on the website and supplies goods/services in accordance with the Terms of Use written below.

These website Terms of Use (hereinafter – the Terms) are an integral part of the goods/service purchase contract and determine the rights and obligations of the Buyer and Seller, the terms and conditions of goods delivery, the procedure for order cancellation and goods return, refund terms, and dispute resolution procedures.

   1. General Terms

If the consumer purchases goods/services through the website, such mutual agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia regulating distance contracts, including but not limited to the Republic of Latvia’s “Consumer Rights Protection Law”, the Cabinet of Ministers Regulations of the Republic of Latvia “Regulations Regarding Distance Contracts”, etc.

   2. Making Purchases

The prices, descriptions, and specifications of products sold in the online store are indicated next to the products.

To place an order, the Client adds the selected product(s) to the shopping cart. The user independently fills in all required fields with information. The client chooses one of the offered delivery methods. The client confirms all information with the "Next" button and can see the total order cost for the selected product(s) with delivery and the provided information. To complete the purchase, the client must press the "Buy" button. After payment of the order, the client will receive a notification that "The order has been received."

   3. Payment Terms

The currency of settlements in the online store is euro. Purchases can be paid for using the offered payment methods provided by the payment platform Klix by Citadele .

Payment options in the online store:

     - Pay by credit and debit card, VISA and MasterCard

     - Online payment method via internet banking: Swedbank, SEB, Citadele, Luminor, Revolut.

NB! When using the internet banking payment method, confirm the order and click the button “Return to merchant”.

Personal data required for making payments are transferred to the licensed payment institution "Citadele banka" AS.

The contract enters into force upon payment to the online store's bank account. If for any reason it is not possible to fulfill the order, the Buyer will be informed and the paid amount will be refunded as soon as possible, but no later than within 14 days after receipt of the notification.

   4. Delivery Terms

Goods are delivered to the following countries: Latvia, Lithuania, Estonia, Finland, Sweden, England, Poland, Germany, Spain, France, Italy. Purchased goods are delivered using: parcel partners, courier service, or in-store pickup. All fees and taxes that must be paid to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are indicated before order confirmation. Purchased goods are delivered to the address specified by the Buyer within 3 to 14 business days. In exceptional cases, the Seller has the right to send goods within up to 45 calendar days, informing the client about this.

   5. Right of Withdrawal

The Buyer has the right to withdraw from the goods within 14 calendar days from the moment of receiving the goods. (Depending on the goods, the buyer may not have mandatory withdrawal rights; in such a case, the reason must be clearly indicated and explained). The right of withdrawal does not apply if the Buyer is a legal entity.

  1. To use the 14-day right of withdrawal, goods may only be used for their intended purpose; the consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If the goods are used inappropriately or damaged, treated carelessly during use, or instructions are not followed, if the original packaging is lost or the packaging is significantly damaged, the online store has the right to reduce the refundable amount according to the decrease in the value of the goods.  
  2. The Buyer covers the cost of returning the goods, except in cases where the reason for return is that the goods do not correspond to the order (for example, incorrect or damaged product). 
  3. The Seller has the right to withhold payment until the Seller has received the goods from the Buyer or proof of return of the goods. If the buyer has chosen a different shipping method than the cheapest one offered by the online store, the online store is not obliged to compensate the excess shipping costs.
  4. The online store is not responsible for delays in the fulfillment of obligations or non-fulfillment, or any other non-performance caused by circumstances and obstacles beyond the online store's reasonable control.
  5. The online store reserves the right to refuse to sell goods and request the return of goods from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.

To use the right of withdrawal, you must submit a withdrawal form, which can be found here: withdrawal form, by sending it to the e-mail address: [email protected], within 14 days after receiving the goods.

The Buyer's obligation is, without delay but no later than within 14 days after sending the withdrawal form to the online store, to send the goods to the Seller. When the Seller receives the returned goods, checks their compliance with the withdrawal terms, and processes the refund, but no later than within 14 days from the moment of receipt, refunds all payments received from the buyer based on the Distance Contract. 

   6. Consumer Rights Regarding Non-conforming Goods

The online store is responsible for the non-conformity of goods sold to the Buyer with the terms of the contract or defects that have arisen within 6 months after the day of delivery to the client, or at the time of delivery, if such an assumption is not contrary to the nature of the item or defect. The Buyer must inform the Seller about the non-conformity of the goods without delay, within 2 months after its discovery, i.e., submit a complaint. The Buyer can submit a complaint by contacting the online store by writing to [email protected].

The online store is not responsible for defects that have arisen after the delivery of the goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the elimination of the defects or exchange for new goods free of charge.

If it is not possible to repair or replace the goods, the Seller returns all payments provided for in the Distance Contract to the Buyer. The Seller provides a written response to the consumer's complaint within 15 days.

   7. Processing of Buyer's Personal Data

The online store processes only those personal data that the buyer has entered when ordering goods, such as name, surname, e-mail, etc.

The online store transfers personal data to the transport service provider(s) to ensure the delivery of goods.

If you have unambiguously agreed to receive our marketing messages, including news, we may occasionally contact you by sending information about our services and latest offers. For this purpose, we may process your e-mail address provided when signing up for marketing e-mails. The Buyer has the option to opt out of marketing messages by notifying us by writing to [email protected].

   8. Dispute Resolution Procedure

In matters not specified in these terms and conditions, the Buyer and Seller undertake to comply with the regulatory acts in force in the Republic of Latvia.

The parties resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If it is not possible to resolve the dispute through negotiations or correspondence, the parties will resolve the dispute in the court of the Republic of Latvia, observing the regulatory acts of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Centre or the court of the Republic of Latvia.

The Buyer also has the right to apply to the dispute resolution institutions of the European Union.

  • Collected personal information: name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number
Payment processing is provided by the payment platform Klix by Citadele, therefore our company transfers the personal data necessary for payment execution to the owner of the platform "Citadele banka" AS.

The website is not intended for individuals under 18 years of age. We do not knowingly collect personal information from children. Our processor Mozello uses limited automated decision-making to prevent fraud, which does not have a legal or otherwise significant effect on you.  Services that include elements of automated decision-making include:

  • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a few hours.
  • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a few days.
